Video: Watch two cross-voting Gujarat Congress MLAs showing their votes to BJP agent during Rajya Sabha polls

The Election Commission invalidated votes of two Congress MLAs Raghav Patel and Bholabhai Gohil after they showed their ballot paper to a BJP agent.  It agreed that their act violated rule 39 of the Conduct of Election Rules which makes it mandatory for an MLA to show his vote to the authorised agent of the party and nobody else.  The Congress party's authorised agent, Shaktisinh Gohil, noticed the MLAs showing their ballots to BJP leaders and lodged a complaint before the returning officer at 9.30 am.

The Election Commission invalidated votes of two Congress MLAs Raghav Patel and Bholabhai Gohil after they showed their ballot paper to a BJP agent.

It agreed that their act violated rule 39 of the Conduct of Election Rules which makes it mandatory for an MLA to show his vote to the authorised agent of the party and nobody else.

The Congress party's authorised agent, Shaktisinh Gohil, noticed the MLAs showing their ballots to BJP leaders and lodged a complaint before the returning officer at 9.30 am.

He also demanded the EC to released full video, which would show the violation of the rule. 

At least two Congress delegations lodged a formal complaint to the EC in Delhi. 

P Chidambaram cited the “precedent” of June 11, 2016, during the Haryana Rajya Sabha polls. As per rule, the ballot paper has to be shown only to the polling agent of the party to which the MLA belongs. 

Though a high-powered BJP delegation sought to refute the argument, the EC went by the precedent and invalidated the votes.
